NY Credit Check Ban

New York has enacted a statewide ban prohibiting most employers from requesting or using consumer credit history in hiring or employment decisions.

The law broadly covers creditworthiness, credit scores, payment history, bankruptcies, judgments, liens, collections, and similar information, whether obtained through a consumer report or directly from an individual.

The ban applies at both the application stage and for current employees and extends to employment agencies as well.

Limited exceptions are built into the law, so employers may still use credit history for certain roles, including:

  • Positions required by state or federal law to conduct credit checks
  • Law enforcement and peace officer roles
  • Positions requiring a federal or state security clearance
  • Roles with significant financial authority (signatory power over $10,000+ in third-party funds or agreements)
  • Non-clerical positions with regular access to trade secrets or national security information
  • Roles involving modification of digital security systems

InfoMart is required to exclude credit information from New York-based consumer reports unless one of the above exceptions applies.

To that end, and effective 4/18/2026, InfoMart has defaulted any credit check ordered in New York to be suppressed; however, we have updated our ordering platforms to include a check box where you can indicate if the position you are hiring for meets one of the exceptions listed above. If that box is checked, then the credit report will proceed as normal.

Please note, integrated accounts will need to update their existing integration to allow for exemption status information to be relayed to InfoMart at the time of order.
